Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of Decibel: dB Sound Meter (the “App”). By downloading, accessing, or using the App, you agree to these Terms, the Privacy Policy, and, where applicable, the Subscription Terms.

2. App Store and Google Play terms

Your use may also be subject to Apple App Store, Google Play, device-manufacturer, and other platform rules. If mandatory platform rules or consumer law conflict with these Terms, the mandatory rules control to the required extent.

3. Eligibility

You must be at least 18 years old to download, access, or use the App. The App is not available to anyone under 18, including with the permission or supervision of a parent or legal guardian.

4. License to use the App

Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, non-commercial purposes. You do not receive ownership of the App, source code, design, trademarks, content, or other intellectual property.

5. Acceptable use

You must not misuse the App, bypass technical restrictions or paid entitlements, interfere with the App or related services, use unauthorized automation, reverse engineer except where law cannot prohibit it, or use the App for an unlawful, harmful, deceptive, invasive, or fraudulent purpose.

In particular, do not use recording, camera, measurement, report, or sharing features for eavesdropping, stalking, harassment, covert recording, unlawful surveillance, infringement of privacy, infringement of intellectual-property or commercial-secret rights, or any other unlawful activity.

6. Features and changes

We may add, modify, suspend, or remove features where permitted by law. Feature availability can depend on your device, operating system, permissions, internet connection, App version, App Store account, platform services, region, and third-party availability. We do not guarantee continuous availability on every device, in every country, or in every App version.

7. Local data and backups

Measurement files, recordings, media, reports, records, names, notes, preferences, and caches are primarily stored locally. Clearing App data, uninstalling, changing devices, system cleanup, loss, damage, or failure can cause data loss. The App does not promise cloud backup. You are responsible for reviewing, exporting, and backing up local data where supported.

Deleting a visible record currently removes its JSON detail and list entry but may not remove an associated M4A audio file. Do not rely on record deletion as a guarantee that every associated local file is deleted; see the Privacy Policy.

8. Recording, media, and user content

You retain responsibility for content you create or share, including audio, photos, videos, report names, notes, and PDFs. You represent that you have all required rights, notices, permissions, and consents to record, capture, create, export, print, or share that content.

Before sharing, review content for personal, confidential, or sensitive information. Once you direct content to a share target, mail service, printer, cloud service, or other third party, that party’s rules and privacy practices apply.

9. Measurement information and no professional advice

Readings depend on device model, microphone, case, microphone position, environment, calibration, frequency weighting, time weighting, accessories, and other conditions. NIOSH, OSHA, GBZ, EU, or other reference views are informational references only.

The App is not a certified sound level meter, noise dosimeter, medical device, occupational-safety compliance tool, hearing-assessment tool, emergency service, or legal-evidence tool. Do not use App results as the sole basis for workplace compliance, legal evidence, medical decisions, hearing decisions, safety decisions, or emergency action. Use calibrated professional equipment and qualified advice in high-risk situations.

10. Permissions and foreground measurement

The App may request microphone, camera, media, storage, and network access only for the relevant feature. On Android, an active measurement may use a foreground microphone service and visible notification so it can continue while the App is in the background. You can stop measurement in the App. Denying or revoking a required permission can limit the related feature.

11. Paid features and subscriptions

The iOS version may offer Pro features through Apple App Store. The current Android Release does not include Google Play Billing or an Android auto-renewing subscription. The applicable Subscription Terms and Apple purchase flow govern iOS billing, renewal, cancellation, restoration, and refund handling. Uninstalling the App does not cancel an active Apple subscription.

12. Third-party services

The App may interact with Apple, Google, Firebase, developer services, IP/geolocation services, system sharing, printing, mail, WebView, and other third-party services. Third parties may have their own terms, privacy policies, technical requirements, and availability limitations. We are not responsible for independent third-party services except as required by law.

13. Intellectual property

The App and its software, interface, graphics, text, logos, features, and materials are owned by us or our licensors and protected by applicable intellectual-property law. You may not use our branding or assets except as permitted by these Terms or law.

14. Feedback

If you submit feedback, suggestions, ideas, or bug reports, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use them for operating, improving, and supporting the App, unless prohibited by applicable law. This does not change the Privacy Policy’s treatment of personal information in support communications.

15. Suspension and termination

You may stop using the App at any time. We may suspend or terminate access where you violate these Terms, law, platform rules, security requirements, or third-party rights. Termination does not remove obligations that by their nature continue, including intellectual-property, disclaimer, liability, and dispute provisions.

16. Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, security, and uninterrupted operation. Some jurisdictions do not permit certain exclusions; those exclusions apply only to the extent permitted.

17. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profits, revenue, goodwill, business opportunity, or use arising from the App. To the maximum extent permitted by law, aggregate liability for a claim related to the App will not exceed the amount you paid for the App or an applicable subscription during the 12 months before the event giving rise to the claim. Nothing limits liability or consumer rights that cannot be excluded by law.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the App operator and its service providers from claims, liabilities, damages, losses, and expenses arising from your unlawful use, your content, your violation of these Terms, or your violation of another person’s rights.

19. Applicable law and mandatory rights

These Terms are interpreted subject to mandatory consumer-protection, privacy, subscription, refund, and other rights that apply where you live. Nothing in these Terms waives a right that law does not permit you to waive. A specific governing law or court is not stated here because the applicable service-provider legal details have not been confirmed.

20. Changes to these Terms

We may update these Terms to reflect changes in the App, platforms, law, or business operations. The updated version will be provided in the App or on the official website. Continued use after an effective update means acceptance only where law permits.
